The Birth Ally – TERMS & CONDITIONS

1. Purpose

These Terms & Conditions govern access to and use of the website owned and operated by Emily Bartlett, trading as The Birth Ally (ABN 75 692 642 907), (hereinafter referred to as “The Birth Ally”, “the doula”, “we”, “us”, “our”) and the provision of doula services.

By accessing this website, making an enquiry, or engaging services, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.

These Terms & Conditions apply generally. Clients who proceed with booking birth support services will be required to enter into a separate written Service Agreement, which governs the specific terms of their individual booking.

2. Website Use

All content on this website, including written material, resources, graphics, downloads, branding, and educational materials, is the intellectual property of The Birth Ally unless otherwise stated.

You may access and view content for personal, non-commercial use only. You must not:

  • Reproduce, copy, distribute or republish website content

  • Use materials for commercial purposes

  • Modify or create derivative works

  • Misrepresent content as your own

Unauthorised use may give rise to legal action.

3. Scope of Doula Practice

The Birth Ally provides non-clinical, non-medical support services, in the form of informational, emotional and physical support during pregnancy, birth and the postpartum period. A detailed description of services is outlined in individual service agreements.

4. Clinical Care Disclaimer

In accordance with the Health Practitioner Regulation National Law (South Australia) (Restricted Birthing Practices) Amendment Act 2013, only a registered midwife or medical practitioner may provide clinical management of labour and childbirth.

The Birth Ally doula does not provide any clinical or medical services and does not replace medical providers. Clients engaging birth support services must have a registered midwife and/or medical practitioner present at birth.

The Birth Ally does not provide support for unassisted or “free births” where no qualified medical or midwifery care is planned.

If no medical provider is present in circumstances where care is required, emergency services may be contacted.

5. Educational Information Disclaimer

Information provided on this website or through services is educational in nature and is not medical advice. While care is taken to provide evidence-informed information, users should always seek advice from qualified healthcare professionals regarding medical matters.

Reliance on information provided through this website is at your own discretion.

6. Trauma-Informed Care

The Birth Ally provides respectful, consent-based, trauma-informed care. Individuals remain in control of their choices, boundaries and participation at all times.

Birth and the postpartum period can be emotionally complex and unpredictable. While every effort is made to provide safe and respectful support, outcomes cannot be guaranteed.

7. Communication and Availability

For contracted birth support Clients, communication methods and response times will be outlined in the signed Service Agreement.

General website enquiries are responded to as reasonably practicable. Availability cannot be guaranteed until a booking is confirmed in writing and any required booking fee is received.

8. Privacy

The Birth Ally manages personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

9. Fees and Payments 

All prices are listed in Australian Dollars (AUD) and, unless otherwise stated, are  inclusive of Goods and Services Tax (GST), where applicable.

Pricing may be updated from time to time without prior notice. Any services or products will be charged at the price in effect at the time your booking or purchase is confirmed.

The Birth Ally reserves the right to modify, update, suspend, or discontinue any part of the Services at any time. Where reasonably practicable, changes will be communicated in advance; however, we will not be liable to you or any third party for any modification, price adjustment, suspension, or discontinuation of Services.

Specific information subject to fees, booking deposits, payment schedules and cancellation terms are outlined in each Client’s signed Service Agreement.

Nothing in these Terms excludes rights under the Australian Consumer Law.

10. Limitation of Liability

Birth is inherently unpredictable.

The Birth Ally provides support within the scope of non-clinical doula practice and is not responsible for:

  • Medical outcomes

  • Clinical decisions

  • Actions of healthcare providers

  • Circumstances beyond reasonable control

12. Amendments

The Birth Ally reserves the right to update or amend these Terms & Conditions at any time, consistent with applicable laws and principles, without notice to you. Updated versions will be published on this website and take effect upon publication. It is your responsibility to review these Terms & Conditions prior to using our Services and periodically during your engagement with us. If at any time you do not agree with these Terms, you should discontinue use of our services.
